Awaiting decisionPeople v. Peters (resentencing)
Will Tina Peters' new sentence be shorter than her original nine years?
Where the case stands
Resentencing ordered by the Court of Appeals (April 2, 2026) remains unscheduled; Colo. Supreme Court declined review Sept 21, 2026; sentence separately commuted by the Governor effective June 1, 2026.
Background
Former Mesa County clerk who became a national election-denial figure; the first U.S. election official convicted of crimes arising from a breach of her own county's voting equipment after the 2020 election.
Charges
- Convicted Aug. 12, 2024 on 7 of 10 counts: four felonies (three counts of attempting to influence a public servant; conspiracy to commit criminal impersonation) and three misdemeanors tied to the 2021 breach of Mesa County's election system
The arguments
Prosecution/State: Prosecutors won convictions on the theory that Peters deceived state officials to sneak an outsider into a secure 'trusted build' software update, leading to leaked voting-system images; the appeals court stressed her offense was 'her deceitful actions,' not her beliefs.
Defense: Peters maintains she was preserving election records and that her prosecution and 9-year sentence punished her political speech; her side seeks a substantially reduced sentence on remand.
The record
- Livestreamed 2024 trial. The 2024 Mesa County trial was streamed and archived by Grand Junction stations (KJCT/KKCO), with day-by-day coverage by CPR.
- Secret meeting recording. A secretly made recording of the May 2021 'trusted build' meeting, played at trial and published in CPR's trial coverage.
The line-setting read at the time this market opened
The reversal was limited to the sentencing court's reliance on her speech; the convictions stand. The same district court resentences with a scrubbed record. A reduction is plausible but not assured — the original judge found her conduct serious enough for the aggravated 9-year package.
Awaiting decision — A resentencing hearing in Mesa County District Court; no date announced. Unclear whether resentencing will occur at all given the May 2026 commutation — human review suggested. The ruling is posted here, and on the board, the moment it's confirmed by two or more independent news organizations.
