Awaiting decisionIbarra v. State (Laken Riley murder appeal)
Will Jose Ibarra's convictions for murdering Laken Riley survive his appeal?
Where the case stands
Notice of appeal filed after sentencing; in January 2026 his appellate counsel pressed claims attacking the TrueAllele DNA analysis and cell-phone evidence, and on March 10, 2026 Judge Haggard denied the new-trial motion, finding the evidence of guilt overwhelming and trial counsel effective. The case now proceeds on direct appeal.
Background
Venezuelan national convicted of the February 2024 murder of 22-year-old nursing student Laken Riley on the University of Georgia campus — the case behind the federal Laken Riley Act and a centerpiece of the national immigration-and-crime debate.
Charges
- Convicted Nov. 20, 2024 after a televised bench trial: malice murder, felony murder, kidnapping with bodily injury, aggravated assault with intent to rape, and related counts; sentenced to life without parole
The arguments
Prosecution/State: The State's trial evidence — DNA under Riley's fingernails matching Ibarra, his thumbprint tied to the scene, digital and video evidence, and the kidnapping/assault findings — was described by the trial judge as overwhelming and powerful.
Defense: On appeal the defense argues the trial court should have excluded the TrueAllele Casework DNA software results and two cellular devices, and that the defense had too little time to analyze raw DNA data and retain an expert, preventing effective confrontation.
The record
- Televised bench trial. The November 2024 trial before Judge Haggard was broadcast and archived; full courtroom video including openings, the State's forensic case and the verdict remains publicly viewable.
- DNA and digital forensics. TrueAllele probabilistic DNA results and cell-phone evidence tying Ibarra to the scene — now the principal targets of the appeal.
The line-setting read at the time this market opened
Bench-trial findings plus a new-trial denial calling the evidence overwhelming make reversal a long shot; the DNA-software suppression claim is the defense's best issue but was squarely rejected below.
Awaiting decision — Appellate briefing and decision on the direct appeal of the convictions; no argument or decision date has been reported. The ruling is posted here, and on the board, the moment it's confirmed by two or more independent news organizations.
