Awaiting decisionOhio v. Angela Wagner (resentencing)
Will Angela Wagner again get 30 years or more at resentencing?
Where the case stands
Sentence (imposed Jan. 2025) reversed and remanded June 26, 2026; resentencing to follow completion of her cooperation obligations, expected after Billy Wagner's trial set for Jan. 11, 2027
Background
Angela Wagner is the mother in the Wagner family that murdered eight members of the Rhoden family in 2016. She pleaded guilty in 2021 under a cooperation deal that dropped the aggravated-murder counts, testified for the state, and was sentenced in January 2025 to the agreed 30 years. The Fourth District vacated that sentence in June 2026 because it was imposed before her testimonial obligations — including at her husband Billy Wagner's upcoming trial — were complete.
Charges
- Pleaded guilty 2021 under cooperation agreement; eight aggravated-murder charges dismissed in exchange for her plea and testimony; prosecutors recommended 30 years with no early release
The arguments
Prosecution/State: The plea agreement calls for 30 years with no early release, and the state has given no indication it will recommend anything different once her testimony is complete.
Defense: Her continued and completed cooperation — including any testimony at Billy Wagner's trial — is the strongest argument for leniency at the new sentencing.
The record
- Fourth District opinion. 2026-Ohio-2488 holds the trial court abused its discretion by sentencing before her plea-agreement testimony obligations were fulfilled, following State v. Gilbert.
- Cooperation record. Her 2021 plea and trial testimony against George Wagner IV are part of the televised trial record.
- Judge Hein's track record. At the vacated January 2025 hearing the same judge departed sharply downward for Jake Wagner while following Angela's agreed 30 years — the wildcard for resentencing.
The line-setting read at the time this market opened
She received exactly the agreed 30 years last time and the vacatur was procedural, so a repeat is the base case — but the same judge showed at the January 2025 hearing that he is willing to depart from plea deals, and completed cooperation could cut the other way.
Awaiting decision — A resentencing hearing in Pike County Common Pleas Court; no date set. The ruling is posted here, and on the board, the moment it's confirmed by two or more independent news organizations.
